Telangana HC to deliver verdict on disqualification of BRS-turned-Congress MLA Danam Nagender
The Telangana High Court will rule on petitions challenging the Assembly Speaker's refusal to disqualify BRS-turned-Congress MLA Danam Nagender under the anti-defection law.
The Division Bench of the Telangana High Court, led by Chief Justice Aparesh Kumar Singh and Justice G.M. Mohiuddin, is scheduled to deliver its verdict on Wednesday, September 16, regarding the disqualification petitions against Khairatabad MLA Danam Nagender.
The court is ruling on petitions filed by BRS MLA Padi Kaushik Reddy and BJP Legislature Party leader Aleti Maheshwar Reddy. The leaders challenged the Telangana Assembly Speaker's decision to dismiss disqualification pleas against Nagender.
Nagender, who won the Khairatabad Assembly seat on a BRS ticket in December 2023, later switched loyalties to the ruling Congress. He contested the Secunderabad Lok Sabha elections on a Congress 'B-form' without formally resigning from the BRS.
Petitioners argued that contesting on another party's ticket provides clear evidence of voluntary defection under the Tenth Schedule. Nagender’s counsel maintained that he remains listed as a BRS member in official Assembly records and has not formally resigned from the party.
The judgment is expected to set a critical precedent for disqualification proceedings involving other defector MLAs in the state.
